{"id":1579,"date":"2022-03-11T10:23:14","date_gmt":"2022-03-11T10:23:14","guid":{"rendered":"https:\/\/www.intratime.es\/?p=1579"},"modified":"2026-04-28T14:31:41","modified_gmt":"2026-04-28T12:31:41","slug":"un-papel-firmado-por-el-empleado-no-tiene-validez-como-registro-de-la-jornada-laboral-segun-la-ley","status":"publish","type":"post","link":"https:\/\/intratime.es\/blog\/un-papel-firmado-por-el-empleado-no-tiene-validez-como-registro-de-la-jornada-laboral-segun-la-ley\/","title":{"rendered":"Un papel firmado por el empleado no tiene validez como registro de la jornada laboral, seg\u00fan la ley."},"content":{"rendered":"\n<p><strong>Una hoja firmada por los empleados no es un sistema de registro de la jornada laboral v\u00e1lido<\/strong>, <a href=\"https:\/\/www.noticiastrabajo.es\/sociedad\/registro-jornada-firmado-trabajador-papel-no-es-valido-lo-sentencia-audiencia-nacional\/\" data-type=\"URL\" data-id=\"https:\/\/www.noticiastrabajo.es\/sociedad\/registro-jornada-firmado-trabajador-papel-no-es-valido-lo-sentencia-audiencia-nacional\/\" target=\"_blank\" rel=\"noreferrer noopener\">decreta la Audiencia Nacional, en sentencia de 15 de febrero de 2022<\/a>.<\/p>\n\n\n\n<p>La juez N\u00fa\u00f1ez Ramos ha explicado que <strong>la empresa debe asegurarse de que el registro de jornada laboral incluya las horas espec\u00edficas de inicio y finalizaci\u00f3n de la jornada <\/strong>de cada empleado, sin comprometer la flexibilidad de tiempo. Adem\u00e1s, debe organizarse y documentarse el acta de este horario de trabajo.<\/p>\n\n\n\n<p>Sin embargo, la magistrada rechaza que el sistema deba recoger de forma desarticulada las variaciones que pueden producirse, como las horas de presencia, las horas trabajadas en d\u00edas libres o prolongaciones de jornada a tiempo parcial, entre otras.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nuevas obligaciones para el registro de empleados<\/strong><\/h2>\n\n\n\n<p><strong>La norma obliga<\/strong>, adem\u00e1s, a la empresa <strong>a conservar los registros durante cuatro a\u00f1os y permanecer a disposici\u00f3n de las personas trabajadoras<\/strong>, de sus representantes legales y de la Inspecci\u00f3n de Trabajo y Seguridad Social.<\/p>\n\n\n\n<p>La normativa no aclara cual debe ser el soporte en el que deben conservarse estos registros, si debe hacerse en papel o en aplicaciones inform\u00e1ticas, pero la l\u00f3gica de los tiempos actuales inclina el parecer de los juzgados de lo Social decantados por esta segunda opci\u00f3n, dado que <strong>esos datos han de estar a disposici\u00f3n de los trabajadores, de sus
