{"id":1742,"date":"2023-01-19T08:56:05","date_gmt":"2023-01-19T08:56:05","guid":{"rendered":"https:\/\/www.intratime.es\/?p=1742"},"modified":"2026-04-28T14:31:41","modified_gmt":"2026-04-28T12:31:41","slug":"la-audiencia-nacional-condena-a-una-empresa-por-no-contar-con-un-registro-de-la-jornada-fiable","status":"publish","type":"post","link":"https:\/\/intratime.es\/blog\/la-audiencia-nacional-condena-a-una-empresa-por-no-contar-con-un-registro-de-la-jornada-fiable\/","title":{"rendered":"La Audiencia Nacional condena a una empresa por no contar con un registro de la jornada fiable"},"content":{"rendered":"\n<p>El registro de la jornada firmado por el trabajador en un papel&nbsp;<u><strong>no es v\u00e1lido.<\/strong><\/u>&nbsp;En su sentencia 22\/2022, de 15 de febrero de 2022, la Audiencia Nacional condena a una empresa por no contar con un registro de la jornada fiable y objetivo para 1.200 trabajadores.<\/p>\n\n\n\n<p>La magistrada ponente concluye se\u00f1alando que la normativa no aclara cual debe ser el soporte en el que deben conservarse estos registros, si debe hacerse en papel o en aplicaciones inform\u00e1ticas, pero \u201cla l\u00f3gica de los tiempos actuales inclina el parecer de los juzgados de lo Social a que el registro se realice por medio de aplicaciones inform\u00e1ticas, dado que esos&nbsp;<strong><u>datos han de estar a disposici\u00f3n de los trabajadores, de sus representantes y de la Inspecci\u00f3n de Trabajo<\/u><\/strong>.\u201d<\/p>\n\n\n\n<p>La Audiencia Nacional concluye que \u201c<strong><u>el sistema implantado no es v\u00e1lido<\/u><\/strong>\u00a0y obliga a la empresa a implantar, en el improrrogable plazo de 30 d\u00edas, un sistema de registro fiable y objetivo que mida el tiempo real de la jornada de cada trabajador y que sea accesible para los trabajadores y para su representaci\u00f3n legal\u201d.<\/p>\n\n\n\n<p><a href=\"https:\/\/winworldev.es\/itime\/blog\/wp-content\/uploads\/2023\/01\/Sentencia.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Enlace a la sentencia<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El registro de la jornada firmado por el trabajador en un papel&nbsp;no es v\u00e1lido.&nbsp;En su sentencia 22\/2022, de 15 de febrero de 2022, la Audiencia Nacional condena a una empresa por no contar con un registro de la jornada fiable y objetivo para 1.200 trabajadores.
